ADSL Terms and Conditions:

Shiftreload ABN 29203769397 (hereinafter referred to as "SHIFTRELOAD") and the Customer (being an entity subscribing to SHIFTRELOAD for the provision of ADSL Services, accept, without limitation or qualification, these terms and conditions;

Service

The service term commences from the date that SHIFTRELOAD accepts the customer order, "Provisioning term". The initial term of agreement will commence from the activation of the service, "Activation date". The initial term is specified by your selection of either a 6 or 12 month agreement followed by renewable 1 month agreements. "Rapid Transfer" or "Churn" customers are automatically put on a 6 month contract but only the "Rapid Transfer" fee applies. If a customer wishes to cancel the service within the "provisioning term", they may do so in writing before the activation date. In the event of cancellation within the provisioning term, SHIFTRELOAD will charge the customer a order cancellation charge of $99. If a customer relocates within the first 6 months of the contract, a fee of $199 applies and the contract "start date" is reset to the date the relocation takes affect. If a customer relocates after their contract has ended, a fee of $99 applies and new 6 month contract term is applied.

SHIFTRELOAD will use its best endeavors to make the ADSL Service available to the Customer 24 hours a day, 7 days a week. The Customer acknowledges that SHIFTRELOAD cannot guarantee uninterrupted service, the speed, performance or quality of the ADSL Service. The Customer further acknowledges that the ADSL Service is not fault free and there may be interruptions and/or access problems from time to time. SHIFTRELOAD depends on the performance of Third Parties over which SHIFTRELOAD has no control and therefore can accept no liability for problems that may arise from the service.

The Customer agrees and understands that in some cases it may not be possible to provide the ADSL Service and in such an event both parties will be released from their obligations under this Agreement and SHIFTRELOAD will have no liability to the Customer. The Customer accepts that some services offered by the Third Party Carrier's Network infrastructure are incompatible with the ADSL Service and may not be available to the Customer, after connection to the ADSL Network.

If the Customer fails to comply with any of the conditions set out in this Agreement and/or with SHIFTRELOAD Terms and Conditions, SHIFTRELOAD may terminate this Agreement immediately. On termination, the Customer's right to use the ADSL Service ceases immediately and SHIFTRELOAD will not be liable for any loss or damage suffered by the Customer. The customer will be liable for any outstanding monies owing on the account and payment of their current agreement period.

The Customer uses the ADSL Service at the Customers own risk and SHIFTRELOAD take no responsibility for any data downloaded and/or the content stored on the Customer's computer. The Customer agrees not to make any claim against SHIFTRELOAD, its suppliers, employees or contractors for any loss, damages or expenses relating to, or arising from, this Agreement or the use of the ADSL Service and SHIFTRELOAD mail service.

This Service must not be used for any illegal or fraudulent activities, including those prohibited under the Australian Government Telecommunications Act or under any other Australian State and Commonwealth laws.

It is the Customer's responsibility to familiarise them selves with Internet etiquette. This service will also not be used for any purposes that may be disruptive of network resources, including but not limited to "spamming" in the form of mass posting of messages to newsgroups, advertising mails and chain letters, or sending threatening, fraudulent or unwanted messages over electronic mail.

The Customer is liable for all data charges relating to the account. Misuse of the Customer account, whether through malicious intent, deliberate action or negligence, is the Customer's responsibility and charges will be incurred for all use until made known to Australia Internet Solutions. It is the Customers responsibility to ensure their computer is not at risk from any form of virus.

 If the Customer acquires the SHIFTRELOAD Service by signing an agreement provided to the Customer by an SHIFTRELOAD Dealer, the Customer acknowledges that the Dealer is acting as SHIFTRELOAD's agent only for the purposes of receiving this agreement from the Customer and providing it to SHIFTRELOAD. The Dealer is not SHIFTRELOAD's agent for any other purposes or in any other capacity and the service, is not provided by the Dealer. The Customer acknowledges that the SHIFTRELOAD Dealer is not the Customer's agent.

Payment to Shiftreload for the provision of the Service can only be made via credit card, PayPal or by direct deposit (EFT) to our bank account.

For Customers paying via credit cards, payment will be debited to the card on the first day of each accounting period. The amount debited to the card consists of two parts:

I) Prepayment for the next period
II) Excess hours or data from the previous month (where applicable)

Payments will be debited to the card on the first day of the month if there are amounts outstanding due to excess usage in the previous month.

 If Shiftreload cannot debit a credit card for any reason, Shiftreload will immediately disable the account until the matter is resolved.

Should an account be suspended due to late payment, a penalty fee of $33 shall be applied to the amount outstanding. These fees are including GST.

The basic assumption is that the Customer wishes to continue with an Account. However, the Customer may terminate this Agreement by giving written notice 21 business days before the end of the prepaid period. The notice may take the form of a short letter, e-mail or request from our website requesting account termination, but must include username and password for verification. Upon receiving the request for account termination, this Agreement will expire as soon as the current period expires subject to these terms and conditions.

In the event that a customer wishes to cancel their account during the initial contract term or agreement a fee of $175 will be charged to the customer.
The minimum 6 month contract starts the day the customers ADSL service is activated (known as the Activation Date) and does not end until exactly 6 calendar months after this date (known as the Contract End Date). These dates can be determined from the customer's welcome email provided to each customer at the time of Activation. It is the customer's responsibility to check their Contract End Date prior to making any changes to their DSL service even if that change is involuntary. If the customer has paid for all 6 months but submits a churn (also known as "Rapid Transfer") request to a new provider or the SHIFTRELOAD ADSL Speed Codes are dropped from the customer's phone line for ANY reason prior to the Contract End Date, an early termination fee of $175 will apply.

Customers are liable for all billable months even if they cease to utilise the service during these periods. The only exception is if a customer has sent us notification, as outlined above, to terminate the service. There can be no suspension of the ADSL service for any period of time.

In the event of Account termination the customer remains liable for all charges until the end of the pre-paid period. No refunds will be granted for any unused Internet air time. The Customer is required to pay all outstanding Charges incurred until the date of the termination.
